59.1 Offences against personal identity  
  Personal identity fraud (or theft) is when another man or woman claims and/or assumes the identity of the victim for the purpose of committing further crimes.  
 
 Primary Fact(s)
 1. That a victim has an existing personal and electronic identify; and
 2. That the victim did not consent for their personal and/or electronic identity to be altered or changed in anyway; and
 3. That the actions of the accused contributed to the alteration and/or changes of the victims personal and electronic identity; and
 4. That the actions of the accused were done with the intent to cause such changes of the victims personal and electronic identity.
 
 
 Penalty Conditions (Level 3-Crime)

a) in the value of the fraud is less than one half the average annual wage;
